Terms and Conditions for the
“HIF Member Perth Wildcats Ticket Give Away (7 November 2024)”
Competition
1. Information on how to enter to win a Prize (defined below) forms part of these terms and conditions (“Terms and Conditions”). Participation in the “Perth Wildcats Ticket Giveaway (7 November 2024)”(“Competition”) is deemed acceptance of these Terms and Conditions. The Competition is not valid in conjunction with any other offer.
2. The Competition is a game of chance for Prizes which may be won by Eligible Entrants (defined below) who submit an Eligible Entry (defined below) in accordance with these Terms and Conditions.
3. Entry into this Competition is limited to one (1) entry per Eligible Entrant.
4. The Promoter is Health Insurance Fund of Australia Limited (HIF) ABN 84 607 276 950 Whadjuk Country, 100 Stirling Street, Perth WA 6000 (“Promoter”).
5. The Competition commences at 12:00pm (AWST) on Wednesday 30 October 2024 and ends at 5:00pm (AWST) on Sunday 3 November 2024 (“Competition Period”).
6. The Competition will be conducted during the Competition Period.
Definitions
7. For the purposes of these Terms and Conditions:
(a) “Competition Submission” means the Eligible Entrant’s completed online entry form.
(b) “Eligible Entrant” or “Eligible Entry” has the meaning given in clause ;
(c) “Immediate Family Member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin;
(d) “Prize” has the meaning given in clause 17;
(e) “Prize Winner” means the Eligible Entry that is selected by a random number generator; and
(f) “Required Information” means the Eligible Entrant’s full name, HIF membership number and email address, together with the Eligible Entrant’s Competition Submission.
Privacy
8. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, suppliers and, as required, to Australian regulatory authorities. Validity of an entry is conditional on providing this information. The Promoter may use the information for the purpose of administering the Competition, marketing, publicity, research and profiling purposes. The Promoter’s privacy policy contains information about how an entrant may access and/or correct his or her information or make a complaint about privacy. See www.hif.com.au/privacy.
Eligibility and Entries
9. To be eligible to enter to win a Prize, an entrant must, during the Competition Period:
(a) be a natural person (and if under 18 years of age, have the written consent of their parent or guardian) and not be a company, business or organisation of any description, or an employee or officer of the Promoter, or of any agency associated with this Competition, or any Immediate Family Member of such a person;
(b) be a resident of Western Australia; and
(c) provide the Required Information to the Promoter by fully completing the entry form at www.hif.com.au/wildcatscomp in accordance with these Terms and Conditions, (each eligible entrant an “Eligible Entrant” and each eligible entry an “Eligible Entry”).
10. An Eligible Entrant may make only one (1) Eligible Entry and is entitled to win no more than one (1) Prize.
11. If this Competition is conducted or involves entry via social media platform, the following conditions must be satisfied:
(a) entry must be submitted by the individual entrant;
(b) the entrant is responsible for ensuring the settings on their personal social media account allows the Promoter to contact them in the event that the Eligible Entrant is a Prize Winner;
(c) the entrant agrees to release each applicable social media platform from all claims based on, related to or arising from the Competition;
(d) the entrant acknowledges and agrees that the use of all social media platforms is subject to the respective terms and conditions of use of the social media platforms;
(e) the entrant acknowledges that the Competition is not associated with, sponsored, endorsed or administered by any social media platform. The entrants, whether or not they are Eligible Entrants, are solely responsible and liable for the content of their entries and/or posts and any other information they transmit to other users of the social media platforms.
Selection and Prizes
12. The Prize(s) will be drawn at 11:00am AWST on Monday 4 November 2024 at 100 Stirling Street, Perth WA 6000.
13. Any person may, by prior arrangement, witness the drawing of the Prize(s).
14. Following the end of the Competition Period, each Eligible Entry will be allocated a number by the Promoter. A random number generator will then be used by the Promoter to select three (3) random numbers, and each number randomly generated will correspond to one (1) Eligible Entrant who will become a Prize Winner.
15. Each Prize Winner will receive one (1) Prize.
16. The total Prize pool is valued at AUD$405 +GST. Bonus prizes will not be awarded.
17. There are three (3) Prizes available in total. The Prize consists of the following: three (3) x Gold Category Double Passes (valued at $135) to the Perth Wildcats Vs Tasmanian Jack Jumpers at the RAC Arena on Thursday 7 November 2024 (“Major Prize”). The prize does not include transportation to or from the game which is the responsibility of the Prize Winner. All expenses other than those expressly referred to in this clause will be at the Prize Winner's cost. The Promoter will not be liable for the failure of the Prize Winner to meet travel schedules or cancellations and no cash or other prize will be awarded if the Prize Winner cancels for any reason.
18. Prize Winners will also be announced at 3.00pm AWST on Monday 4 November 2024 on the Promoter’s Facebook and Instagram pages. The Prize will be delivered by way of electronic ticket to the email address nominated by the Eligible Entrant no later than the day prior to the game day.
19. If a Prize Winner fails to accept or decline their Prize by 10:00am AWST on Wednesday 6 November 2024, the Prize Winner will be deemed to have forfeited their Prize. In those circumstances, the Promoter reserves the right to conduct a redraw of any unclaimed prizes within 24 hours of the previous draw in accordance with the terms and conditions of the Competition.
20. If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to equal or greater value.
21. The Prize is not transferable or exchangeable and is not redeemable for cash.
22. The Prize is issued by Perth Wildcats and is subject to the terms and conditions specified on the electronic ticket.
23. The Promoter's decision is final and no correspondence will be entered into.
24. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions, who tampers with the entry process, or who is not otherwise an Eligible Entrant. Errors or omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
General
25. Entrants consent to the Promoter using their name and/or image in the event they are a Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), complying with legislative requirements and promoting any products or services distributed and/or supplied by the Promoter.
26. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate, subject to the approval of all relevant state and territory regulatory authorities.
27. Any disputes by Eligible Entrants concerning the conduct of the Competition or the claiming of a Prize are to be resolved by contacting HIF Complaints at the details provided below at clause
28. Subject to clause 30, the Promoter (including its officers, employees and agents) excludes all liability for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, loss or damage arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any Prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter);
(d) any variation in the Prize value to that stated in these Terms and Conditions; and
(e) any tax liability incurred by a entrant.
29. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) ("CCA”) or any other legislation which may not be excluded, restricted or modified by agreement.
30. These Terms and Conditions are governed by the laws of Western Australia.
