Terms and Conditions

1.     Information on how to enter to win a Prize (defined below) forms part of these terms and conditions (“Terms and Conditions”). Participation in the “HIF 70 Prizes Giveaway”(“Competition”) is deemed acceptance of these Terms and Conditions. The Competition is not valid in conjunction with any other offer.

2.     The Competition is a game of chance for Prizes which may be won by Eligible Entrants (defined below) who submit an Eligible Entry (defined below) in accordance with these Terms and Conditions.

3.     Entry into this Competition is limited to one (1) entry per Eligible Entrant.

4.     The Promoter is Health Insurance Fund of Australia Limited (HIF) ABN 84 607 276 950 Whadjuk Country, 100 Stirling Street, Perth WA 6000 (“Promoter”).

5.     The Competition commences at 12:01am (AWST) on Tuesday 1 October 2024 and ends at 11:59pm (AWST) on Thursday 31 October (“Competition Period”).

6.     The Competition will be conducted during the Competition Period.

Definitions

7.     For the purposes of these Terms and Conditions:

(a)     Competition Submission” means completing and submitting the online entry form at hif.com.au/70.

(b)     "Eligible Entrant” or “Eligible Entry” has the meaning given in clause 9;

(c)     Immediate Family Member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin;

(d)     Prize” has the meaning given in clause 16;

(e)     Prize Winner” means the Eligible Entry that is selected by a random number generator;

(f)     Required Information” means the Eligible Entrant’s full name, membership number, email address and State or Territory of residence within the Eligible Entrant’s Competition Submission.

Privacy

8.     The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, suppliers and, as required, to Australian regulatory authorities. Validity of an entry is conditional on providing this information. The Promoter may use the information for the purpose of administering the Competition, marketing, publicity, research and profiling purposes.  The Promoter’s privacy policy contains information about how an entrant may access and/or correct his or her information or make a complaint about privacy.     Eligibility and Entries

    9.     To be eligible to enter to win a Prize, an entrant must, during the Competition Period:

    (a)     be a natural person over 18 years of age and not be a company, business or organisation of any description, or an employee or officer of the Promoter, or of any agency associated with this Competition, or any Immediate Family Member of such a person;

    (b)     be a resident of Western Australia to win any of the Perth Wildcats passes; and be an Australian resident to win any other prizes which include St John First Aid Kits or $70 cash cards.

    (c)     provide the Required Information to the Promoter by fully completing the entry form in accordance with these Terms and Conditions,

    (each eligible entrant an “Eligible Entrant” and each eligible entry an “Eligible Entry”).

    10.     An Eligible Entrant may make only one (1) Eligible Entry and is entitled to win no more than one (1) Prize.

    Selection and Prizes

    11.     The Prize(s) will be drawn at 10:00am (AWST) on Friday 1 November 2024 at HIF Offices, located at 100 Stirling Street, Perth WA 6000. 

    12.     Following the end of the Competition Period, each Eligible Entry will be allocated a number by the Promoter. A random number generator will then be used by the Promoter to select seventy (70) Prize Winners, and each number randomly generated will correspond to one (1) Eligible Entrant who will become a Prize Winner.

    13.     Where the prizes are of different value, the prize of the highest value will be drawn first and the second and subsequent prizes will be drawn in descending order.

    14.     Each Prize Winner will receive one (1) Prize.

    15.     The total Prize pool is valued at AUD$12,440 +GST Bonus prizes will not be awarded.

    16.     Prize details:

    a.     Ten (10) double gold passes to a Perth Wildcats game at RAC Arena (each double gold pass is valued at $135) (for WA – based members only)

    (i)     x2 double gold passes for game on Friday 15/11/2024 at 18:30

    (ii)     x2 double gold passes for game on Sunday 01/12/2024 at 13:30

    (iii)     x2 double gold passes for game on Friday 06/12/2024 at 18:30

    (iv)     x2 double gold passes for game on Wednesday 22/01/2025 at 18:30

    (v)     x2 double gold passes for game on Saturday 25/01/2025 at 17:00; or

    b.     Ten (10) double passes to HIF’s corporate box at a Perth Wildcats game at RAC Arena including catering and a parking pass (each double pass is valued at $850) (for WA-based members only) on:

    (i)     x2 double passes for game on Friday 15/11/2024 at 18:30

    (ii)     x2 double passes for game on Sunday 01/12/2024 at 13:30

    (iii)     x2 double passes for game on Friday 06/12/2024 at 18:30

    (iv)     x2 double passes for game on Wednesday 22/01/2025 at 18:30

    (v)     x2 double passes for game on Saturday 25/01/2025 at 17:00; or

    c.     Twenty (20) St John First Aid Kits (each kit valued at $24.50); or

    d.     Thirty (30) $70 cash cards.

    17.     Prize Winners will be notified in writing via email within seven (7) days of the Prize draw that they have won a Prize, and the Prize will be delivered by way of post (or email for Perth Wildcats tickets) to the address/email address nominated by the Eligible Entrant.

    18.     If a Prize Winner fails to accept their Prize by 10:00am (AWST) on Friday 15th November 2024, the Prize Winner will be deemed to have forfeited their Prize. In those circumstances a redraw will occur at 10:01am (AWST) Friday 15 November at HIF Offices, located at 100 Stirling Street, Perth WA 6000. Any relevant Prize Winners will be notified in writing via email of their win/forfeiture within seven (7) days. The Promoter reserves the right to conduct a redraw of any unclaimed prizes within fourteen (14) days of the previous draw in accordance with the terms and conditions of the Competition.

    19.     Prize Winners (including last name, first initial and postcode) will also be announced on Monday 11 November at 12:00pm (AWST) on the Promoter’s competition winners’ page: hif.com.au/members/competition-winners

    20.     This competition is not open to:

    (a) Directors, employees or contractors of HIF Australia.

    (b) Non-members of HIF Australia.

    21.     If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to equal or greater value.

    22.     The Prize is not transferable or exchangeable and is not redeemable for cash.

    23.     Cash cards or event tickets issued by an entity other than the Promoter are subject to the terms and conditions specified by any third-party on issue.

    24.     The Promoter's decision is final, and no correspondence will be entered into.

    25.     The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions, who tampers with the entry process, or who is not otherwise an Eligible Entrant. Errors or omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    General

    26.     Entrants consent to the Promoter using their name and/or image in the event they are a Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), complying with legislative requirements and promoting any products or services distributed and/or supplied by the Promoter.

    27.     If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate, subject to the approval of all relevant state and territory regulatory authorities. 

    28.     Any disputes by Eligible Entrants concerning the conduct of the Competition or the claiming of a Prize are to be resolved by contacting HIF support at the details provided below at clause 32.

    29.     Subject to clause 31, the Promoter (including its officers, employees and agents) excludes all liability for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, loss or damage arising out of the following:

    (a)     any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

    (b)     any theft, unauthorised access or third party interference;

    (c)     any Prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter);

    (d)     any variation in the Prize value to that stated in these Terms and Conditions; and

    (e)     any tax liability incurred by an entrant.

    30.     Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) ("CCA”) or any other legislation which may not be excluded, restricted or modified by agreement.

    31.     These Terms and Conditions are governed by the laws of Western Australia.
